Description of activity. Indoor top-rope and lead climbing on walls up to 45 feet, auto-belay use, bouldering on pads, and optional instructor-led clinics.

1. Assumption of Risk

I UNDERSTAND AND ACKNOWLEDGE that the activity described above (the “Activity”) involves inherent and substantial risks that cannot be eliminated, including without limitation:

Falls from height; bruises, abrasions, sprains, strains, dislocations, and fractures; rope burn; equipment failure; collision with walls, holds, or other climbers; serious injury, permanent disability, paralysis, and death.

I voluntarily assume full responsibility for any and all such risks, known and unknown, and for any loss, damage, or injury (including death) I may sustain as a result of participating.

2. Waiver and Release of Claims

In consideration of being permitted to participate, I, on behalf of myself, my heirs, personal representatives, and assigns, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Summit Vertical Gym, LLC, its owners, officers, directors, employees, agents, volunteers, contractors, and affiliates (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by me in connection with the Activity, whether caused by the negligence of the Released Parties or otherwise. This waiver does not apply to claims arising from the gross negligence or willful misconduct of the Released Parties.

3. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys’ fees, they may incur arising out of my participation in the Activity, to the fullest extent permitted by the laws of the State of Colorado.

4. Medical Treatment Authorization

I authorize the Released Parties to secure, at my expense, such emergency medical treatment as they deem necessary in the event I am unable to consent. I confirm that I have medical insurance covering injuries sustained during the Activity.

5. Photo / Video Release

I consent to the use of my name, likeness, photograph, and video recording taken during the Activity for promotional, editorial, educational, and marketing purposes, without compensation and without further notice.

Governing Law & Severability

This waiver shall be governed by the laws of the State of Colorado. If any provision is held unenforceable, the remainder shall remain in full force and effect.

I HAVE READ THIS WAIVER, UNDERSTAND THAT IT IS A RELEASE OF LIABILITY, AND SIGN IT VOLUNTARILY.
